Terms of Service

1. Acceptance of Terms

By accessing or using Welcome to El Salvador ("the Platform"), operated by Simbyotics, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

2. Services Offered

The Platform provides three categories of services:

• Tours & Experiences: Online booking of guided tours and experiences in El Salvador.
• Real Estate Listings: Display of properties for sale and rent, with inquiry facilitation. We are not real estate agents and listings are for informational purposes only.
• E-Commerce: Purchase of authentic Salvadoran products from local artisans and producers.

3. User Accounts

To access certain features you must create an account with accurate, complete, and current information. You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Booking and Payment Terms

• All prices are displayed in US Dollars (USD).
• Payment is required in full at the time of booking.
• Bookings are confirmed only upon receipt of full payment and a confirmation email.
• We accept PayPal and major credit/debit cards via Stripe.
• Prices are subject to change without notice until a booking is confirmed.

5. Cancellation and Refund Policy

Tours:

• Cancellations made 24+ hours before the tour: full refund.
• Cancellations made within 24 hours: 50% refund.
• No-shows and cancellations within 2 hours: non-refundable.

Products:

• 30-day return window for unused items in original packaging.
• Items damaged in transit: full replacement or refund.
• Handcrafted artisanal items are final sale unless damaged.

6. Product Shipping

We ship to the United States, Canada, and Europe. Shipping times are estimates only and are not guaranteed. Risk of loss passes to you upon delivery to the carrier. We are not responsible for delays due to customs, weather, or carrier issues beyond our control.

7. Intellectual Property

All content on the Platform — including text, photography, graphics, logos, and software — is owned by Welcome to El Salvador or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Welcome to El Salvador and Simbyotics shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or its services. Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.

9. Disclaimer of Warranties

The Platform is provided "as is" without warranties of any kind. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. Real estate listings are provided for informational purposes and we make no representations regarding accuracy or availability.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of El Salvador. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of San Salvador, El Salvador.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of the Platform after changes constitutes acceptance of the revised Terms.
